These are the terms (“Terms”) governing the booking of places at the annual British Arrows Event (“Event Booking”) which occurs in the first six months of any calendar year as is further detailed on the event website located at www.britisharrows.com (“Event Website") or communications to you from us. By booking a place you agree to be bound by these terms and please read them carefully.

These Terms are issued by the British Advertising Broadcast Awards Limited/The British Arrows Limited which trades as British Arrows.

These Terms relate to Event Bookings only and do not extend to the sponsoring of awards or participating in the awards process.

The Booking
An Event Booking does not automatically guarantee confirmation of a place at the event. An Event Booking cannot be made without full payment which is due by the date specified on the Event Website. All Event Bookings are made on a first-come, first-served basis. We reserve the right to refuse Event Bookings at our sole discretion.

The details of the British Arrows Event publicised on the Event Website when you booked are correct at the time booking, but we reserve the right to make whatever changes we deem necessary to accommodate any changes in the British Arrows Event as further detailed in these Terms.

It is your responsibility to inform us of any change to the contact address, telephone number or email address you provide us with at the time of an Event Booking.

The Event
An individual Event Booking will entitle you to the following:

  • a glass of sparkling wine or a soft drink on arrival
  • dinner and half a bottle of wine

There will be a cash bar for any additional drinks, which will be open before the awards take place at the British Arrows Event and at the after party. You can also order additional wines, champagne, beer or drinks from the wine waiter at your table, which are payable by credit or debit card.

Seats are allocated on a first-come, first-served basis and we cannot guarantee any particular seat. Some tables may be better placed than others and we are obliged to offer these to those who book earliest.

Tables seat ten people. You may book less than ten places in which case you will share with other companies to make up full tables. We will do our best to ensure that sharing arrangements are satisfactory and any reasonable requests are fulfilled but you recognise that we do so at our discretion and make no guarantee as to the seating arrangement. We reserve the right to change the seating arrangements due to unforeseen circumstances. All individuals that these changes affect will be notified when practicably possible.

You must inform us of any dietary requirements no later than the date specified on the Event Website including requests for vegetarian, vegan, halal and kosher meals, or any allergies to guarantee we can fulfil your request.

The Venue
Event Bookings are issued subject to any specific rules and regulations of the venue at which the British Arrows Event is taking place. Each venue has its rules regarding what is acceptable behaviour and has the right to refuse admission or request that people leave the venue.

You shall at all times comply with any rules, policies and procedures as issued or notified to you by the venue, including all health and safety policies and procedures and all reasonable instructions of the venue staff.

The rules are available on written request.

Payment
Payment for an Event Booking must be received in full by the date specified on the Event Website. Tickets for an Event Booking will not be released until such time as funds have been cleared and will be delivered to the registered name and email address approximately 2 weeks before the event. Any part payments received before the date specified on the Event Website will be regarded as non-refundable deposits.

If full payment is not made by the date specified on the Event Website, this will be considered a breach of contract by you, and we will be entitled to reallocate your Event Booking and in the event we are unable to reallocate your Event Booking you acknowledge and agree that we shall be entitled to recover the full payment from you in respect of the Event Booking.

Cancellation
In exceptional circumstances we may change the date and/or venue for the British Arrows Event and we will give you as much notice as we can. If as a consequence you do not wish to attend the British Arrows Event then there is no automatic right to a refund for an Event Booking. These terms will continue to apply to the revised event including the obligation to make the full payment for the Event Booking.

We may cancel an event at any time for any reason and at our discretion we shall reimburse any Event Booking payment where we are unable to offer any alternative form of event including any online event as a replacement. We reserve the right to deduct any reasonable costs we may have incurred from the payment to be made to you. We shall have no other liability to you.

If you wish to transfer the Event Booking then, provided that we have been given details of your replacement, we shall allow you to transfer the Event Booking to someone else.

Force Majeure
Neither party shall be liable to the other in respect of any non-performance of its obligations by reason of any act of God, civil war or strife, act of foreign enemy, invasion, pandemic, war, satellite failure, legal enactment, governmental order or regulation, industrial action, trade dispute, lock-out, riot or any other cause beyond their respective control provided always that in any such event the duration of the agreement between the parties shall be extended over which such event continues.

Privacy and Consent for Filming
You understand and acknowledge that to the extent the data submitted by you in connection with an Event Booking amounts to personal information, such personal information will be processed in accordance with the requirements of applicable data protection laws and our privacy policy as available on the Event Website. If you are making an Event Booking on behalf of others, we process that data strictly on the basis that the others have authorised you to do this on their behalf.

This personal data includes photographs, dietary preferences and access requirements. This is “special category data” which we will process on the lawful basis that you (or the third party) have expressly and voluntarily given consent.

Please note that as an attendee of this Event, we will be sharing your email address with the event sponsors. If you do not wish to have your details shared, then please let us know by emailing awards@britisharrows.com

The only personal data we will retain after the event is:

  1. CCTV and film cameras may be present at the Event. By entering the Event, you consent to being photographed, filmed and/or recorded, and consent to the image or recording of you being used in distribution (commercial or otherwise) in perpetuity without any payment,
  2. financial data for accounting purposes; and
  3. your contact details to inform you of future events.

All other personal data including any data regarding dietary or access will be deleted.

Notwithstanding the express consent you have given for the processing of special category data; our lawful basis for processing is this contract and that it is a legitimate interest for us to inform people in our industry of our activities.

The British Arrows Awards Limited or its agents may carry out film or sound recording in or around the venue at the British Arrows Event. By making an Event Booking you consent to you and your party being included in any recording, and to its exploitation, without payment. If you take pictures and tag us on social media or if you take pictures with our photographers – we are likely to share these on our channels, and beyond.

The British Arrows is dedicated to creating an inclusive and accessible environment for everyone, irrespective of age, disability, gender identity, job role or position, marital or civil partnership status, nationality, pregnancy or maternity, race, religion or belief, sex, sexual orientation, or socio-economic group.

Liability
Personal arrangements including travel, accommodation or hospitality relating to the British Arrows Event which have been arranged by you are at your own risk. Unless otherwise stated in this clause, our and the venue’s liability to you in connection with the British Arrows Event shall be limited to the price paid by you for the Event Booking.

Neither The British Arrows nor the venue will be responsible for any loss, injury or damage to any person (including you) or property howsoever caused (including by us and/or by British Arrows Event partner(s)): (a) in any circumstances where there is no breach of a legal duty of care owed by us or the venue); (b)in circumstances where such loss or damage is not a reasonably foreseeable result of any such breach (save for death or personal injury resulting from our negligence); or (c) to the extent that any increase in any loss or damage results from breach by you of any of these Terms and/or any terms and conditions of the British Arrows Event partner(s).

Nothing in these Terms seeks to exclude or limit our or the event partner(s)’ liability for death or personal injury caused by our or the British Arrows Event partner(s)’ (as relevant) negligence, fraud or other type of liability which cannot by law be excluded or limited.

General
If any provision of these Terms is found by any court or competent authority to be invalid, unlawful or unenforceable in any jurisdiction, that provision shall be deemed not to be a part of these Terms and this shall not affect the enforceability of the remainder of these Terms nor shall it affect the validity, lawfulness or enforceability of that provision in any other jurisdiction.

Any provision of these Terms shall not be enforceable by a third party (as defined in the Contracts (Rights of Third Parties) Act 1999.

These Terms shall be governed by the laws of England and Wales and shall be subject to the exclusive jurisdiction of the English Courts.
